Indian Constitution

The Constitution of India has some distinct and unique features as compared to other constitutions to the world. As Dr. B. R. Ambedkar, the Chairman of the Drafting Committee puts it, the framers had tried to accumulate and accommodate the best features of other constitutions, keeping in view the peculiar problems and needs of our country. The following are the salient features of the Constitution of India. 1. Longest written constitution Indian Constitution can be called the largest written constitution in the world because of its contents.In its original form, it consisted of 395 Articles and 8 Schedules to which additions have been made through subsequent amendments. At present it contains 395 Articles and 12 Schedules, and more than 80 amendments. There are various factors responsible for the long size of the constitution. One major factors was that the framers of the constitution borrowed provisions form several sources and several other constitutions of the world. They have fol lowed and reproduced the Government of India Act 1935 in providing matters of administrative detail.Secondly, it was necessary to make provisions for peculiar problems of India like scheduled castes, Scheduled Tribes and backward regions. Thirdly, provisions were made for elaborate centre-state relations in all aspects of their administrative and other activities. Fourthly, the size of the constitution became bulky, as provisions regarding the state administration were also included. Further, a detail list of individual rights, directive principles of state policy and the details of administration procedure were laid down to make the Constitution clear and unambiguous for the ordinary citizen.Thus, the Constitution of India became an exhaustive and lengthy one. (2) Partly Rigid and Partly Flexible The Constitution of India is neither purely rigid nor purely flexible. There is a harmonious blend of rigidity and flexibility. Some parts of the Constitution can be amended by the ordinar y law-making process by Parliament. Certain provisions can be amended, only when a Bill for that purpose is passed in each house of Parliament by a majority of the total membership of that house and. by a majority of not less than two-third of the members of that house present and voting.Then there are certain other provisions which can be amended by the second method described above and are ratified by the legislatures of not less than one-half of the states before being presented to the President for his assent. It must also be noted that the power to initiate bills for amendment lies in Parliament alone, and not in the state legislatures. Pundit Nehru expressed in the Constituent Assembly, â€Å"While we want the Constitution to be as solid and permanent as we can make it, there is no permanence in Constitution. There should be certain flexibility.If you make anything rigid and permanent, you stop the nation’s growth, the growth of a living, vital organic people. † 3) A Democratic Republic India is a democratic republic. It means that sovereignty rests with the people of India. They govern themselves through their representatives elected on the basis of universal adult franchise. The President of India, the highest official of the state is elected for a fixed term. Although, India is a sovereign republic, yet it continues to be a member of the Commonwealth of Nations with the British Monarch as its head.Her membership of the Commonwealth does not compromise her position as a sovereign republic. The commonwealth is an association of free and independent nations. The British Monarch is only a symbolic head of that association. 4) Parliamentary System of Government India has adopted the Parliamentary system as found in Britain. In this system, the executive is responsible to the legislature, and remains in power only as long and it enjoys the confidence of the legislature. The president of India, who remains in office for five years is the nomina l, itular or constitutional head. The Union Council of Ministers with the Prime Minister as its head is drawn from the legislature. It is collectively responsible to the House of People (Lok Sabha), and has to resign as soon as it loses the confidence of that house. The President, the nominal executive shall exercise his powers according to the advice of the Union Council of Ministers, the real executive. In the states also, the government is Parliamentary in nature. 5) A Federation Article 1 of the Constitution of India says: – â€Å"India, that is Bharat shall be a Union of States. Though the word ‘Federation' is not used, the government is federal. A state is federal when (a) there are two sets of governments and there is distribution of powers between the two, (b) there is a written constitution, which is the supreme law of the land and (c) there is an independent judiciary to interpret the constitution and settle disputes between the centre and the states. All the se features are present in India. There are two sets of government, one at the centre, the other at state level and the distribution of powers between them is quite detailed in our Constitution.The Constitution of India is written and the supreme law of the land. At the apex of single integrated judicial system, stands the Supreme Court which is independent from the control of the executive and the legislature. But in spite of all these essential features of a federation, Indian Constitution has an unmistakable unitary tendency. While other federations like U. S. A. provide for dual citizenship, the India Constitution provides for single citizenship. There is also a single integrated judiciary for the whole country.The provision of All India Services, like the Indian Administrative Service, the India Police Service, and Indian Forest Service prove another unitary feature. Members of these services are recruited by the Union Public Service Commission on an All-India basis. Because th ese services are controlled by Union Government, to some extent this constitutes a constraint on the autonomy of states. A significant unitary feature is the Emergency provisions in the Indian constitution. During the time of emergency, the Union Government becomes most powerful and the Union Parliament acquires the power of making laws for the states.The Governor placed as the constitutional head of the state, acts as the agent of the centre and is intended to safeguard the interests of the centre. These provisions reveal the centralising tendency of our federation. Prof: K. C. Wheare has rightly remarked that Indian Constitution provides, â€Å"a system of government which is quasi-federal, a unitary state with the subsidiary unitary features†. The framers of the constitution expressed clearly that there exists the harmony of federalism and the unitarism. Dr.Ambedkar said, â€Å"The political system adopted in the Constitution could be both unitary as well as federal accor ding to the requirement of time and circumstances†. We can say that India has a â€Å"Cooperative federalism† with central guidance and state compliance. 6) Fundamental Rights â€Å"A state is known by the rights it maintains†, remarked Prof. H. J. Laski. The constitution of India affirms the basic principle that every individual is entitled to enjoy certain basic rights and part III of the Constitution deals with those rights which are known as fundamental rights.Originally there were seven categories of rights, but now they are six in number. They are (i) Right to equality, (ii) Right to freedom, (iii) Right against exploitation, (iv) Right to freedom of Religion, v) Cultural and Educational rights and vi) Right to constitutional remedies. Right to property (Article-31) originally a fundamental right has been omitted by the 44th Amendment Act. 1978. It is now a legal right. These fundamental rights are justiciable and the individual can move the higher judiciar y, that is the Supreme Court or the High Courts, if there is an encroachment on any of these rights.The right to move to the Supreme Court straight for the enforcement of fundamental rights has been guaranteed under Article 32 (Right to Constitutional Remedies). However, fundamental rights in India are not absolute. Reasonable restrictions can be imposed keeping in view the security-requirements of the state. 7) Directive Principles of State Policy A novel feature of the Constitution is that it contains a chapter in the Directive Principles of State Policy. These principles are in the nature of directives to the government to implement them for establishing social and economic democracy in the country.It embodies important principles like adequate means to livelihood, equal pay for both men and women, distribution of wealth so as to subserve the common good, free and compulsory primary education, right to work, public assistance in case of old age, unemployment, sickness and disable ment, the organisation of village Panchayats, special care to the economically back ward sections of the people etc. Most of these principles could help in making India welfare state. Though not justiciable. These principles have been stated a; â€Å"fundamental in the governance of the country†. ) Fundamental Duties A new part IV (A) after the Directive Principles of State Policy was incorporated in the constitution by the 42nd Amendment, 1976 for fundaments duties. These duties are: i) To abide by the Constitution and respect its ideals and institutions, the National Flag and the National Anthem; ii) To cherish and follow the noble ideals, which inspired our national struggle for freedom; iii) To uphold and protect the sovereignty, unity and integrity of India; iv) To defend the country and render national service when called upon to do o; v) to promote harmony and the spirit of common brotherhood amongst all the people of India transcending religious, linguistic, regional or sectional diversities, to renounce practices derogatory to the dignity of woman; vi) to value and preserve the rich heritage of our composite culture; vii) to protect and improve the natural environments including forests, lakes, rivers and wild life and to have compassion for living creatures; viii) to develop scientific temper, humanism and the spirit of inquiry and reform; x) to safeguard public property and to abjure violence; x) to strive towards excellence in all spheres of individual and collective activity so that the nation constantly rises to higher levels of Endeavour and achievement. The purpose of incorporating these duties in the Constitution is just to remind the people that while enjoying their right as citizens, should also perform their duties for rights and duties are correlative. 9) Secular State A secular state is neither religious nor irreligious, or anti-religious.Rather it is quite neutral in matters of religion. India being a land of many religions, the f ounding fathers of the Constitution thought it proper to make it a secular state. India is a secular state, because it makes no discrimination between individuals on the basis of religion. Neither it encourages nor discourages any religion. On the contrary, right to freedom of religion is ensured in the Constitution and people belonging to any religious group have the right to profess, practice or propagate any religion they like. 0) An Independent Judiciary The judiciary occupies an important place in our Constitution and it is also made independent of the legislature and the executive. The Supreme Court of India stands at the apex of single integrated judicial system. It acts as protector of fundamental rights of Indian citizens and guardian of the Constitution. If any law passed by the legislature or action taken by the executive contravenes the provisions of the Constitution, they can be declared as null and void by the Supreme Court.Thus, it has the power of judicial review. Bu t judicial review in India constitutes a middle path between the American judicial supremacy in one hand and British Parliamentary supremacy in the other. 11) Single Citizenship The Constitution of India recognises only single citizenship. In the United States, there is provision of dual citizenship. In India, we are citizens of India only, not of the respective states to which we belong. This provision would help in promoting unity and integrity of the nation.

Navy seals

After striving to indicate a person who has had a significant influence on me I have come to a conclusion, that rather than a individual person I have a particular group. This particular group is unlike any other in the I the world. This group consists of elite men who put their homeland before themselves, they are capable of putting the needs of others before their own. These men were willing to do everything and anything to become part of the elite group known around the world as the Navvy Seals.Navvy seals are groups of elite soldiers, known around the world for their abilities in he air on the land and in the sea. These soldiers lead the world in their special oops. They are unlike another soldiers in the world, willing to risk their lives for anyone in need around the world. Ready to assist and cry for help. I see the Navvy Seals the way most people my age see pro sports players. Like pro sports players the SEALS are the best of the best. Their training and tactical work is so v igorous that their number one philosophy is â€Å"the easy day was yesterday†. Which is one of many in the Navvy.To be given the opportunity to serve my country a a Navvy Seal would mean the world to me. I would spend every breathing moment being the best I can be for my country family and myself. All my life I have wanted to be affiliated in the military. Four to five years ago I had very low self confidence in myself and others and not very great aspirations. My plan was to enroll in the marines after high school and attain my college education from the military. My primary aspiration for my life was to exceed the achievements of my mother, who didn't graduate high school.I wanted to be able to say if I could do it why couldn't you? My mind and heart were consumed by the dreadful thought of my rothers and how they would never have the opportunities that I have been blessed with. It wasn't until I had opened up to my uncle Derek who is a marine that I had a change of heart a bout virtually everything past and present. My uncle was in absolute disagreement with my plan. He explained the importance of college to my and the pride that comes with the privilege of becoming a marine that will extinguish my desire to exceed the accomplishments of my moms.Together we looked through the different military academies and I found Annapolis the most interesting because their classes in economics. I have a strange liking towards economics, like the stock market and the economy. Those thing Just really seem to interest me to I hope to major in economics and international trade while attending Annapolis. My interest in international trade comes from my desire to travel, which is another one of the many reasons I aspire to be a Navvy Seal. Ever since I was little I've wanted to see the world, and what it has to offer.There is absolutely no better way at accomplishing that dream other than attending Annapolis become a Navvy Seal, and sounds to go to be true, but I know i n my heart that in order to accomplish that goal I ave to be mentally and physically tough enough to get there. Speaking about becoming physically and mentally tough I have already begun those first small steps. It started off with small attitude adjustments such as my love for athletics, instead of dreading the next workout I changed the dreading into excitement that put me in the mindset to get better rather than Just get through the workout.Eventually I got to a point where my moms actions didn't influence my mind as much. In fact I changed my entire perspective on my mom, although, she isn't perfect she chose her path and being angry about that isn't helping me or her in nyway. So instead of being angry I chose put all the extra time I spent being angry and wishing things could be different to actually make a difference in my life not Just for me but for her my brothers and anyone else that thinks they can't do it.I feel like a much better person, free from the invisible chains that ranted excuse after excuse of why I couldn't or didn't get the Job done. I find happiness and hope to be the greatest things in life and I know whole heartedly that the SEALS brought those thing to me. Nothing makes me happier than getting a good grade on an ssignment and knowing I've gotten Just a tad bit closer to my dream. I can sometimes get lost in my thoughts of the the future, to the point where I feel as if I'm reading a good book with precise imagery.Imagining myself 10 years from now along side the best special pops team in the world, seeing the world and serving my country. Another exciting thing about the SEALS is their brotherhood. The fact that they would risk their lives for one another is breath taking. They would rather all sacrifice their lives saving one of their own than leaving them behind. Their goal number one oal in operations it to complete the given task unnoticed, quietly, quickly, and most importantly together.Like family these men will do anything f or each other and will go to the ends of the earth to protect their own. The final thing I will mention is the SEALS ability to be wherever they are needed whenever they are needed. No matter the circumstance they are always willing to put their lives on the line for whomever is in need. Which is also like something I've always done. I may not meet the needs or standards of everyone but I will always go out of my way to help someone in need.Not only because I know it is the right thing to do but because I remember when I didn't have much and someone would go out of their way to help me. I will never forget those people which makes it necessary for me to do the same for others. All that being said I don't believe that I am perfect by a long shot, there are thousands, heck millions that have it ten times worse than me and have beat the odds. But one thing is for sure once given the chance I will do everything I'm my power to be the best I can be for myself and my country,

There are many impacts and implications of academic stress on the health of an individual in the academic environment as a student. Some of these impacts and implications are time management skills, social life, and being employed. This paper will be examining the role and significance of the perception in the academic environment and how there is an increase of stress and anxiety in college.Also, I will construct my personal Medicine Wheel to show how can manage my own stress and anxiety being in the Coco optional Therapist Assistant and Physiotherapist program (TOT/PTA). The first impact and implication that will be being discussed is time management skills and how it increases stress and anxiety in college. Firstly, transiting from high-school into college brings on a huge amount of stress because it's completely two different worlds and adjusting is very hard for some.This may cause the Generalized anxiety disorder (GAD) and this is the cost common type of anxiety, it is a  "ongoing state of mental and/or physical tension and nervousness, either without a specific cause† (Put Reference). Some of the symptoms are constant restlessness, irritation, trouble concentrating, and fatigue. Guide dogs help blind or visually impaired people get around the world. In most countries, they are allowed anywhere that the public is allowed, so they can help their handlers be any place they might want to go. To do this, a guide dog must know how to: keep on a direct route, ignoring distractions such as smells, other animals and people, maintain a steady pace to the left and just ahead of the handler, stop at all curbs until told to proceed, turn left and right, move forward and stop on command, recognize and avoid obstacles that the handler won’t be able to fit through (narrow passages and overheads), stop at the bottom and top of stairs until told to proceed, bring the handler to elevator buttons, lie quietly when the handler is sitting down, help the handler to board and move around buses, subways, and other forms of public transport ation, and finally, to obey a number of verbal commands (Fueoco, 2001).   Ã‚  Ã‚  Ã‚  Ã‚  Additionally, a guide dog must know to disobey any command that would put the handler in danger. My Last Duchess :: Robert Browning, My Last Duchess

Robert Browning is the author of "My Last Duchess" and he shows the audience how it is a dramatic monologue. In a class lecture, the professor had mentioned that the poem is set in the 15th century. During that time, it was common for a young woman to be arranged in a marriage. As the poem unfolds, the audience learns the speaker of the poem, Duke Ferrara, is talking to another male character and begins to tell the story of his previous wife. As they are standing in front of the portrait of the Duke's last wife, now dead, the Duke talks about her imperfections. The reader discovers that the ex-wife's "imperfections" were qualities such as generosity, courtesy to those who served her, and an overall respected woman. What follows are examples on the nature and personality of the Duke. Browning lets the reader to believe that the Duke has found flaws of his previous wife because she did not respect his rank and his power. More importantly, the Duke did not approve the behavior of his previous wife and will tolerate it again. As the story begins, the Duke is speaking to the other male character about the portrait of his previous wife. A painter by the name of Fra Pandolf had painted the portrait and it is said that Pandolf's hands may have wandered as well. The following lines can make the audience wonder about the relationship between Pandolf and the Duke's ex-wife. "That piece a wonder, now: Fra Pandolf's hands / Worked busily a day, and there she stands" (lines 3-4). The Duke is now left to wonder that if his ex-wife and Pandolf may have had a relationship of some sort. In the poem, the Duke does not reveal the painting to any person. He is the only person that is allowed to reveal the portrait from the curtains that cover it. Although he does not show anyone t he portrait, the Duke had revealed the painting to the other character. "The depth and passion of its earnest glance But to myself they turned (since none puts by The curtain I have drawn for you, but I) And seemed as they would ask me, if they durst" (8-11). The audience is learning very early in the poem that the Duke questioned his relationship with the Duchess in the portrait. It is at this moment in the poem that the Duke begins to tell the reasons he did not trust his ex-wife.

Critical Analysis of Taylor Swift’s Red Essay

Grammy award winning artist Taylor Swift debuted her first album at in 2006. Within six years Swift has grown to be one of the most renowned country pop artists ever known. With her fans craving for more from Swift, she released her fourth album titled â€Å"Red† on October 15, 2012. The album was an instant hit that sold over 1.2 million copies within the first week of being released. â€Å"Red† is one of the top selling albums in the past five years, coming only behind Mumford & Son’s recently released â€Å"Babel†. The album contains 16 tracks that are a strange mix of Swift’s country roots, modern pop, and hints of lite-rock. The highly anticipated, supposed â€Å"album of the year† turned out to be a major disappointment. At least Taylor has an easy excuse: her horrible decision to try out some new producers and song writers such as Max Martin and Shellback, who are known for creating hit radio pop songs for Maroon 5, Pink and Kelly Clarkson. These two were mainly responsible for the most disappointing tracks: â€Å"I Knew You Were Trouble† (a song that bashes ex-boyfriend John Mayer even further than she did in her album â€Å"Speak Now†), â€Å"22† (a song about enjoyment of young adulthood), and the hit single â€Å"We Are Never Ever Getting Back Together†. On the other hand, Swift did have Nathan Chapman, her longtime producer, help her with almost half the album, which includes the most notable tracks on â€Å"Red† such as â€Å"All Too Well†, â€Å"The Lucky One†, and â€Å"Treacherous†. Another plausible reason for Swift’s subpar performance in the production of â€Å"Red† is her obvious self-confusion with her own identity. When Taylor released her first album she was barely 16 years old. Now, she is 22 but is still trying to write songs about the same old heartaches and heartbreaks that she had when she was a teenager. Since she was made famous and praised for the songs about first kisses, first break ups, and dumb boys, it makes sense that she would continue to write songs about the same topics and, naturally, a true transition from a hopeless romantic of a teenager to a real adult must be out of Swift’s comfort zone and a bit intimidating. But the fact is that now Swift is no longer a teenager and therefore should not be writing about teenager-like relationships. She never discloses any intimate details about her relationships in her songs unlike most 22 year-old artists. Instead, she successfully portrays the perfect role of an untouchable, chaste virgin disguised as a serial dater looking for the next guy to write a song about. The best track on the album, that was co-produced by Nathan Chapman, is â€Å"All Too Well† which is a slower, acoustic-based ballad written all by Swift herself. The song fits Taylor’s original style perfectly, encapsulating the platonic ideal of unfair heartbreak as she also does in many songs in her previous albums such as â€Å"Cold As You† in her self titled album, â€Å"Breathe† in her second album â€Å"Fearless†, and â€Å"Dear John† in her third album â€Å"Speak Now†. â€Å"All Too Well† is about her former boyfriend, actor Jake Gyllenhaal (which of who most of the album is about), and the story of their short, but apparently serious relationship spent specifically on a weekend at his sister Maggie’s house. The song is emotional and has a powerful climax that describes how he broke up with her over a phone call, which is typical for Taylor Swift and what her fans love and expect. Overall, the album lacks originality both lyrically and melodically. As Taylor takes steps further away from her love stricken lyrics and country roots and more towards passive aggressive pop rock tunes the worse off she gets and consequently leaves her fans disappointed. Although the album does contain a couple genuinely well written and produced tracks, the general confusion of which genre Swift tries to reflect in â€Å"Red† throws off the album as a whole. Hopefully Swift will soon learn how to use all of her potential to become a true adult artist that has evolved from her past glory as a teenage country legend.

CST & the Criminal Justice System Essay

â€Å"I am convinced that imprisonment is a way of pretending to solve the problem of crime. It does nothing for the victims of crime, but perpetuates the idea of retribution, thus maintaining the endless cycle of violence in our culture. It is a cruel and useless substitute for the elimination of those conditions–poverty, unemployment, homelessness, desperation, racism, and greed–which are at the root of most punished crime. The crimes of the rich and powerful go mostly unpunished.† (Howard Zinn) This quote simplifies my evolved awareness of the issue concerning crime and the criminal justice system has grown. Beginning this unit I had a basic understanding of crime around the world but had almost zero knowledge about the criminal justice system and as we move on throughout this unit I was completely shocked with the some of the things going on in this very corrupt system. Just through the first activity, California Peace Officers Association: California Prisons Under Pressure, the information presented to me that the flaws of this justice system was in the way it was structured, mainly that jails are overcrowded and understaffed. Also more money is put in jails than education because of the increasing rate of inmates year by year. This activity helped me realize that prisons are very flawed and this impacts the issue of crime and criminal justice system greatly. Another very surprising activity was the PBS Frontline: Case for Innocence, which showed how inmates may be wrongly convicted through false evidence and even DNA such as in the case of Earl Washington who spent almost 18 years in prison because he was falsely charged for murder of a 19 year old girl in Culpepper, Virginia soon to be released because of the lack of evidence in the case to prove him guilty. Stories like these tend to happen more than often because the carelessness put in looking through cases by police officers and even the jury. Also year-by-year the system receives higher and higher advancements in technology, which can be a factor in determining the innocence of a victim accused. After being introduced to the horrible system of justice we talk more about specific reasons of arrests such as child abuse, which is one of the main issues that occur within inmates today. It was very surprising to see that an estimated annual cost of child abuse and neglect in the United States for 2008 was $124 billion, which is something that needs to be dealt with in the near future. Child abuse showed that it may be on of the contributing causes to why many inmates are stuck in prison today, statistics shows that children who face child abuse and neglect are more likely to be involved in criminal activities. This was one of the most surprising statistics that I came across because it showed one of the root causes to why the jail system is overcrowded and this is an issue that can be addressed. We need to regulate more the issue of child abuse because these children are left defenseless such as Emma was to her mother’s boyfriend. Many of these activities showed the structural flaws within the criminal justice system and the crime that occur within the United States but later as we got into more about the death penalty my views on this topic changed greatly. My opinion at first towards the death penalty was that if the crime was gruesome enough then the person should also pay through being put to death but after watching â€Å"Dead Man Walking† my opinion on this issue completely changed. It showed me that through counseling and programs showed in the movie, the inmate could truly change for the better. And that we should move forward in the direction of helping rehabilitate the inmate rather than using the death penalty because it is not only expensive but in affective towards the long term goal of living in a progressive and harmonious society. One very positive way to lead us to this society is through restorative justice, which has made a huge positive impact throughout the United States. Restorative justice programs are very affective in places such as prisons and even schools, where we’ve seen the decrease in violence and alternatives to suspension from school such as a face to face supplement which is seen as a much better solution and more affective in high schools. I was very happy to see the restorative justice programs being such a huge success and a step towards fixing the criminal justice system problem. Another great step that is occurring is with the Catholic Church and their movement into stopping the death penalty which is another great way to dealing with the situation through responsibility, restoration, and rehabilitation. The idea of the death penalty seemed completely wrong to me after reading a story from the Murder Victim’s Families for Reconciliation where a women lost her brother but didn’t want to death penalty placed on her brother’s murderer but to put him in counseling programs because an added death wouldn’ t have solved anything. And seeing the forgiveness and the logic behind this woman’s thinking I saw that the death penalty isn’t an affective way of solving a problem basically a way of â€Å"pretending to solve the problem of crime.† Every single activity and experience throughout this course of this unit was very powerful and influential in developing my awareness and understanding from knowing a few very small facts about the criminal justice system to now a vast majority of statistics and information about this system. Throughout this unit we’ve seen many structural flaws with the death penalty throughout the policies, laws, and institutions presented to us in all the online resources. Some of these flaws are proximate and some are distal. One main flaw we see in the presentation of the death penalty is that is it racially biased. Since 1977 race has been a huge factor when deciding upon the decision if one is guilty or innocent, statistics show that more people have been exe cuted for killing white victims than for killing black victims. The death penalty is also corrupt because it claims innocent lives due to lack of evidence of their wrongful conviction and it is not a deterrent. One of the most important flaws that regards is that the death penalty costs is much more expensive and takes away from other areas in the criminal justice system such as improving the jail systems. This has shown to be more of a huge downfall rather than a improving the criminal justice by implementing the death penalty. The death penalty is still more expensive than alternative sentences, and with counseling that inmate can be rehabilitated. The death penalty is less affective and unnecarsily expensive. We also see that the death penalty looks past issues such as mental illness, these flaws are just the proximate flaws we see in the criminal justice system. There are also many distal causes to the structural flaws we see in the criminal justice system such as poverty, unemployment, homelessness, racism, and greed, which are most likely the reason for most crimes occurring. Because the lack of resources to help each and every one of the these topics the cycle of crime continues to r epeat itself over and over again mainly punishing the same people for the same crimes that they continuously commit. Another huge flaw is the mindset the corrupt government has about the criminal if that crime is committed by a poor, unemployed person the sentencing is twice and more than if a rich and powerful person committed that crime. And again, using the death penalty doesn’t quickly solve any problems in the long term but actually hurts the United States. Through the restorative justice systems we can see a great improvement and slowly we can accomplish decreasing the number of inmates in prison. If someone goes through counseling and rehab there are less likely to repeat the actions in the past that got them in the situation in the first place. Whereas, the death penalty costs so much more and killing someone isn’t going to solve anything. Through structural analysis we can conclude that the criminal justice system is greatly flawed and we need to come together as a nation and help improve the current conditions of this system. The Catholic views on issues and actions regardin g crime and the criminal justice greatly conflict with my newfound views on crime and the criminal justice system. The idea of teaching right from wrong, respecting life and the law, forgiveness and mercy is very good way to address this huge issue. The Church provides the idea that â€Å"society must protect† its citizen from crime and punish the ones who break the law, which is a great way to help this issue through various ways such as workshops for parents and counseling for anyone who is struggle in this system. This will help solve the problem early on and give the children and other young people a chance in life from committed those mistakes they may have committed without the help of these programs. One great idea is the â€Å"option for the poor and vulnerable† because the factor of financial issues throughout society is a distal cause to people landing themselves in prisons. People who don’t have the right resources from their childhood tend to look towards crime for various reasons. Proper nutrition, shelter, health care, and protection can be one of the many ways of helping these people to move away from crime. And the Church is doing a great job to address this issue and fulfilling the needs of those who need it through charity and advocacy. These two ideas that the Church has presented are very important surrounding our system of retributive justice. From the policy recommendations the most important to the least important would be protecting society from those who threaten life, inflict harm, take property, and destroy the bonds of community, promote serious efforts toward crime prevention and poverty reduction, challenging the culture of violence and encouraging a culture of life, rejecting simplistic solutions such as three strikes and you’re out and right mandatory sentencing, offering victims the opportunity to participate more fully in the criminal justice process, encouraging innovative programs of restorative justice that provide the opportunity for mediation between victims and offenders and offer restitutions for crimes committed, insisting that punishment has a constructive and rehabilitative purpose, making a serious commitment to confront the pervasive role of addiction and mental illness in crime, e ncouraging spiritual healing and renewal for those who commit crime, treating immigrants justly, and finally placing crime in a community context and building on promising alternatives that empower neighborhoods and towns to restore a sense of security. The first policy I chose was because I agree with the idea of protecting people from violence and crime, if they aren’t expose to it then they are less likely to be involved with things related to violence and crime. Everyone should be able to live in a setting without fear and be able to grow up feeling safe. And when being punished their needs to be a purpose and the punishment needs to be helpful in shaping the person back to the right path in society. The second policy was chosen because the efforts toward crime prevention and poverty reduction are key factors in helping the criminal justice system. Factors such as poverty and discrimination are huge reasons why inmates land themselves in jail and if we can stop this early on through poverty reduction and other programs we can stop these problems early on rather than after the crime is committed. Educating, supporting, and fighting poverty are key aspects in stopping the crime that is going on today. The last policy that was chosen is rejecting right mandatory sentencing; we should do everything to make sure that the punishment fits the crime. Every crime should be analyzed thoroughly and given a punishment regarding that crime and not a solution that is given to every crime because of what is stated. Every crime is different under different circumstances and we should not just take the easy route and remove the criminal from society until they are no longer a danger to us. These policies are very important in implementing through the Church to help the issue of the flawed criminal justice system to be fixed. In conclusion, my understanding of crime and the criminal justice system has greatly evolved in many ways through the activities and experiences we went through in this unit. Two major CST themes that were greatly presented through this unit were Rights and Duties and Common Good. We’ve seen that many people end up in jail because they don’t have the basic necessities to get by day to day which tend to cause them to look towards crime, Right and Duties states that â€Å"every human has the right to basic material to live a decent life.† Also we see Common Good playing a role in this unit, through the restorative programs we see the changes made by the inmates and how provide with the right teachings, these criminals can really change and benefit the community. Many things that were presented greatly surprised me and made me want to be more involved with this issue because it is a social mission to help the problem within the criminal justice system. Social action is key to help in trying to one day get more restorative programs and help abolish the death penalty for good because two wrongs don’t make a right. In the end I would personally get rid of the death penalty not only because it is expensive and ineffective but because research has greatly shown that through counseling and advocacy programs the inmates gain much more than being put to death. Not only do the inmates benefit from this but also society in general will greatly benefit from these programs because the inmates will come out given a second chance and be positive impacts to the community around them and lead the United States in a more progressive and harmonious society.

Cost of Capital – Marriott as a Whole There are several ways to approach Marriott’s cost of capital as an entire firm. One way is to use CAPM to find its cost of equity, long-term interest rates for the cost of debt, and weigh according to its capital structure to find WACC. Under this method, we lever the previously found firm-wide ÃŽ ²U of .79 to the desired 3/2 debt-to-equity ratio to find a cost of equity of 17.12%. We use the arithmetic rather than geometric since CAPM is a one-period model. For Marriott’s cost of debt, we add the credit spread of 1.3% to the ten-year Treasury yield of 8.72%. Plugging all these variables into CAPM, we arrive at a WACC of 10.53%. Another method to finding Marriott’s cost of capital is by taking a weighted average of its three segments. Since its three segments have different business models – it may be helpful to see the cost of capital as a mix of its three divisions rather than an aggregate Marriott unit. Weighing each division by the same weights in the Contract Services section, we calculate that WACC is 11.3% A couple of items to note on Marriott’s firm-wide cost of capital are noted here. Marriott’s WACC measures the cost of capital for the whole Marriott Corporation. Marriott has three lines of business –each line of service has its unique cost of deb t and beta, so when valuing investments in those three service lines, we would use their own WACC instead of using Marriott’s WACC. If the firm only uses one hurdle rate for evaluating investment opportunities in each line of business, it may accept or reject some investment project improperly. From the question below we already found that the WACC for lodging and restaurants is not the same. So for example, if just using one hurdle rate, like 10%, to evaluate the project among these two line of service, the lodging service may reject this project while the restaurant service may accept it.
